El objetivo de la investigación es interpretar el discurso de psicólogos/as que ejercen docencia para la carrera de Psicología en una(s) Universidad(es) Estatal, Privada con Aporte y Privadas de la V Región, Chile, desde un enfoque de subjetividad laboral. Se realizan 6 entrevistas en profundidad a Psicólogos/as y análisis de discurso. El capitalismo académico produce un elevado número de docentes con flexibilidad laboral contractual o trabajo no decente, pues no existe: estabilidad laboral, derecho a sindicalización, vacaciones periódicas pagadas, ni protección (...) social. Estas condiciones son invisibilizadas en el debate sobre la calidad de la Educación. En este contexto, la subjetividad laboral del malestar docente se expresa como: agotamiento, estrés e incertidumbre vital que hace más difícil el trabajo de formación de futuros/as psicólogos/as en la V Región y en el país. El objetivo de la investigación es interpretar el discurso hegemónico (icónico-lingüístico) de los Fundamentalismos Religiosos de Iglesia Católica y grupos ligados a ella, respecto al aborto, junto a las protestas realizadas por movimientos de ciudadanas y ciudadanos por la defensa de los Derechos Sexuales y Reproductivos de las mujeres en países de la Subregión Andina. La metodología utiliza un análisis de discurso. En conclusión: El discurso y penalización del aborto es ideológico, dominación patriarcal que hace adoptar a las mujeres el (...) aborto inseguro como resistencia paralegal, pudiendo enfermar o morir para obtener la libertad sobre su cuerpo, un derecho reproductivo. In the 5th century BC, in Athens, Antiphon reflects on the relationship between physis and nómos in a way quite different from most sophists. Indeed, one of the particularities of sophist thought is to minimize physis so that thinking focus itself on nómos, on what man can, through thinking and debate, establish in regard to the common good and justice in the pólis. However, Antiphon takes up this relationship between nature and law to direct it to another path. In an (...) unusual way for a sophist, we see physis being emphasized at the expense of nómos. The comparison between the two concepts also serves as a backdrop for harsh criticisms of justice and laws. The objective of this article is, through the criticisms Antiphon makes to the system of the laws of the pólis, to think about the relationship established by the sophist between physis and nómos in order to find out if there is a new understanding of these concepts and to reflect the reason that led Antiphon to revisit them. Em 1821, Friedrich W. Schelling inaugura um novo caminho para o seu pensamento. Esse novo caminho, como afirma o próprio filósofo, divide sua filosofia em duas partes, a saber, a filosofia negativa, que diz respeito a toda sua produção anterior, e a filosofia positiva que se inaugura a partir das aulas de Erlangen. Contudo, como veremos neste artigo, suas duas filosofias estão unidas na busca pelo pensamento da Unidade. Essa busca traduz-se na Spätphilosophie como busca do Absoluto. O presente artigo (...) tem como objetivo refletir sobre os escritos da chamada Filosofia da Mitologia que visam pensar o caminho do Absoluto. Tal caminho relaciona-se com o caminho percorrido pela própria consciência humana e, ao mesmo tempo, coincide com ela. Portanto, a análise culminará no que chamou de processo mitológico e sua relação com o politeísmo sucessivo, já que a mitologia teria se constituído graças à sucessão dos deuses efetuada na consciência humana. In 1821, Friedrich W. Schelling opens a new path for his thinking. This new path, as affirmed by the philosopher himself, he divides his philosophy in two parts: the negative philosophy, which concerns all his previous production, and the positive philosophy that is inaugurated by the Erlangen courses. However, both philosophies are linked together by the search of the thought of the Unity, a search manifested in the Spätphilosophie as the quest for the Absolute. The present article aims to reflect upon the writings of the so-called Philosophy of Mythology, which intends to think about the way to the Absolute. Such way is related to the path followed by the human conscience itself and, at the same time, it coincides with the conscience itself. Therefore, the analysis shall culminate in what Schelling called "mythological process" and in its relation with the successive polytheism, since mythology may have constituted itself by the succession of gods, effected in human conscience. Se propone que esta última adopte un giro político y uno pedagógico con el fin de recuperar su espíritu original y reconectarse con la tradición intelectual latinoamericana. The psychological work environment is composed of both stressful and motivational work conditions at different levels of analysis. However, most relevant theory and research lack an integrative conceptualization and appropriate instrumentation to account for this work context structure. These limitations are particularly present in non-mainstream populations, such as the Spanish community of researchers and practitioners. In this study, based on the job demands–resources model, we present an updated conceptualization in which stressful and motivational psychosocial factors are integrated and defined at (...) the job, the group, and the organizational level of analysis into a single conceptualization. Furthermore, derived from this conceptualization, we present a study of the development and validation of a questionnaire to account for the psychosocial work environment in Spanish, labeled Psychosocial Factors Questionnaire 75, which provides measures for 23 different psychosocial factors. The results of this study supported the questionnaire’s construct, convergent, divergent, and predictive validity, together with its reliability. Thus, this conceptualization and questionnaire provides researchers and partitioners with a more comprehensive approach to the assessment of the psychosocial work environment and promises benefits for interventions in the workplace. Job satisfaction is a core variable in the study and practice of organizational psychology because of its implications for desirable work outcomes. Knowledge of its antecedents is abundant and informative, but there are still psychological processes underlying job satisfaction that have not received complete attention. This is the case of employee emotion regulation. In this study, we argue that employees’ behaviors directed to manage their affective states participate in their level of job satisfaction and hypothesize that employee affect-improving and -worsening (...) emotion regulation behaviors increase and decrease, respectively, job satisfaction, through the experience of positive and negative affect. Using a diary study with a sample of professionals from diverse jobs and organizations, for the most part, the mediational hypotheses were supported by the results albeit a more complex relationship was found in the case of affect worsening emotion regulation. This study contributes to expanding the job satisfaction and emotion regulation literatures and informs practitioners in people management in organizations about another route to foster and sustain positive attitudes at work. Bullying is a phenomenon that affects children and adolescents worldwide, and it has major consequences for all participants involved in these situations. In Chile, researchers have validated several instruments used to investigate aggression between peers and school violence, but there is a lack of validation of instruments to investigate bullying. The purpose of this study was to provide evidence of the validity and reliability of the Olweus Bully/Victim Questionnaire—Revised version in the Chilean context. The participants were 2,775 students from schools (...) of low, medium, and high socioeconomic status. OBVQ-R is a self-report questionnaire with 42 items, which has been used in different countries, and has adequate psychometric properties to assess the prevalence of victimization and aggression and various forms of bullying worldwide. Results confirmed the two-factor structure of the OBVQ-R and good reliability. These dimensions seem to be correlated. Comparison between OBVQ-R with the School Violence between Peers Questionnaire and the Internet Experiences Questionnaire showed some degree of agreement. The Item Response Theory analysis showed that the item about verbal bullying, in both subscales, had the lowest-severity parameters, meaning that these forms of bullying were the most prevalent. The higher-severity parameter in the victimization scale was the cyberbullying item, and the sexual bullying item showed higher severity in the perpetration subscale. The differential item functioning analysis by gender showed a trend in which boys responded with lower-severity parameters than girls. In the victimization scale, the exception was the item about spreading rumors, and in the perpetration subscale, it was the item about racial bullying. We have provided evidence of the validation of OBVQ-R among school-age children and adolescents in Chile. This study is part of a trial registered at ClinicalTrials.gov, number NCT02898324. (shrink)

In this paper, we raise two points. First, any rights‐based theory should provide a method by which to guide reasoning in addressing conflicts of rights. The reason, we argue, is that these theories must provide guidance on what should be done. Second, this method must contain two key recommendations: (1) We should try to find a deliberative mechanism through which none of the rights is simply eliminated from the scene; (2) these rights may be balanced against each other to define (...) which right should prevail, but without considering non‐rights‐interests as if they were rights in the process. These recommendations instantiate two crucial principles that underlie our common intuitions on rights, namely, the principle that rights deserve equal respect and the principle that rights should be taken seriously. Staiger [Kolmogorov complexity and Hausdorff dimension, Inform. and Comput. 103 159–194 and A tight upper bound on Kolmogorov complexity and uniformly optimal prediction, Theory Comput. Syst. 31 215–229] and K. Tadaki [A generalisation of Chaitin’s halting probability Ω and halting self-similar sets, Hokkaido Math. J. 31 219–253] have studied the degree of randomness of sequences or reals by measuring their “degree (...) of compression”. This line of study leads to various definitions of partial randomness. In this paper we explore some relations between these definitions. Among other results we obtain a characterisation of Σ1-dimension in terms of strong Martin-Löf ε-tests , and we show that ε-randomness for ε is different than the classical 1-randomness. (shrink)

Este artículo intenta comprender un aspecto fundamental de la obra de León Rozitchner, en cierto modo relegado: la hermenéutica en que se sostiene su filosofía. Se trata de comprender el modo de leer (o releer) que la filosofía de Rozitchner pone en juego, y que implica más que un conjunto de glosas y relaciones eruditas el intento de una dis-torsión del sentido, algo como la refracción que produciría la significación cuando su sentido debe atravesar la propia vivencia para ser verificado. Sin embargo, esta hermenéutica no aparece en la obra de Rozitchner como una teoría explícita ni como un conjunto de técnicas, normas o métodos, por lo que para comprenderla será necesario explicitarla y sistematizarla. Para ello, y a modo de hipótesis de trabajo, usaremos como guía algunos aspectos de la reflexión hermenéutica que desarrolla Paul Ricoeur a propósito de su trabajo sobre Freud, especialmente los conceptos de restauración y sospecha. Kitcher has proposed an ideal-theory account—well-ordered science (WOS)— of the collective good that science’s research agenda should promote. Against criticism regarding WOS’s action-guidance, Kitcher has advised critics not to confuse substantive ideals and the ways to arrive at them, and he has defended WOS as a necessary and useful ideal for science policy. I provide a distinction between two types of ideal-theories that helps clarifying WOS’s elusive nature. I use this distinction to argue that the action-guidance problem that WOS faces (...) remains even under the aims/means distinction, because the WOS’s failure is more basic than critics have suggested. The mixture of political, social, cultural and economic environments in Latin America, together with the enormous diversity in climates, natural habitats and biological resources the continent offers, make the ethical assessment of agricultural policies extremely difficult. Yet the experience gained while addressing the contemporary challenges the region faces, such as rapid urbanization, loss of culinary and crop diversity, extreme inequality, disappearing farming styles, water and land grabs, malnutrition and the restoration of the rule of law and social peace, can be (...) of great value to other regions in similar latitudes, development processes and social problems. This chapter will provide a brief overview of these challenges from the perspective of a continent that is exposed to the consequences of extreme inequality in multiple dimensions and conclude by arguing for the need to have a continuous South-South dialogue on the challenges of establishing socially and environmentally sustainable food systems. El autor pretende desentrañar a través de la interpretación jurídica el o los sistemas jurídico penal que los legisladores tomaron en consideración para crear y dar vigencia a los Códigos Penal y de Procedimientos penales vigentes en el Estado Libre y Soberano de México, que fueron tomado como ejemplo, para demostrar que la ley no solo se crea de aspectos abstractos sino también de los criterios que han emitido los juristas en su trabajo.

Food security brings a number of benefits to humanity from which nobody can be excluded and which can be simultaneously enjoyed by all. An economic understanding of the concept sees food security qualify as a global public good. However, there are four other ways of understanding a public good which are worthy of attention. A normative public good is a good from which nobody ought to be excluded. Alternatively, one might acknowledge the benevolent character of a public good. Others have (...) argued that public goods demand being public in the sense of being visible to all. Finally, it has also been argued that public goods are those goods which need joint action to be produced and maintained. This chapter discusses these five understandings of the public good in relation to food security and highlights the advantage of assessing policies from each of these perspectives. (shrink)

Decaying wood, while an abundant and stable resource, presents considerable nutritional challenges due to its structural rigidity, chemical recalcitrance, and low nitrogen content. Despite these challenges, certain insect lineages have successfully evolved saproxylophagy (consuming and deriving sustenance from decaying wood), impacting nutrient recycling in ecosystems and carbon sequestration dynamics. This study explores the uneven phylogenetic distribution of saproxylophagy across insects and delves into the evolutionary origins of this trait in disparate insect orders. Employing a comprehensive analysis of gut microbiome data, (...) from both saproxylophagous insects and their non‐saproxylophagous relatives, including new data from unexplored wood‐feeding insects, this Hypothesis paper discusses the broader phylogenetic context and potential adaptations necessary for this dietary specialization. The study proposes the “Detritivore‐First Hypothesis,” suggesting an evolutionary pathway to saproxylophagy through detritivory, and highlights the critical role of symbiotic gut microbiomes in the digestion of decaying wood. The much-discussed “claimability objection” holds that it is unjustified to believe that all individuals have a human right to subsistence because the bearers of the correlative duties are not sufficiently determined. This argument is based on the so-called “claimability-condition”: S has a right to P if and only if the duty-bearer is sufficiently determined. Practice-based theorists defend the human right to subsistence by arguing that if we take the existing human rights practice seriously, there is no indeterminacy about the allocation (...) of duties. In this paper, I challenge this (apparently compelling) defense of the human right to subsistence with a dilemma. If the claimability condition is true, the practice-based defense fails to undermine the claimability objection because the duty-bearer is determined in some, but not all, cases. If practice-based theorists reject the claimability condition, they generate an account of human rights that is problematic from the practical perspective because it may contain duties that are unable to guide action. Is it justified to hold that an agent S has a (moral) right to P if the duty-bearer is not specified? There is an intense ongoing debate on this question. There are two positions in the literature. On the one hand, O´Neill´s much-discussed account of rights holds that it is justified to say that an agent S has a right to P if and only if the duty-bearer is sufficiently determined – i.e. if and only if it is clear against (...) whom S may claim her right to P (O’Neill 1986, 1988, 1996, 2000, 2005, 2016). Call this, the ‘claimability condition’. On the other hand, interest-based theorists argue that it can be justified to say that an agent S has a right to P even if the duty-bearer is not sufficiently determined (Caney 2007; Griffin, 2008; Raz 1988; Tasioulas 2007; see also: Etinson, 2013; Ypi 2010). Who (if anyone) is correct in this fundamental discussion about the very nature of rights? In this paper, I provide an answer to this crucial question. Neither O´Neill nor interest-based theorists provide good reasons to justify their positions. However, I argue, the claimability condition is an existence condition of rights justified on the basis of their action-guiding character. The reason is that if the duty-bearer is not specified, the content of the right (its correlative obligation) does not sufficiently guide what the agent should do because it is indeterminate who is required to act (or refrain from acting). The debate about how neurotechnologies impact authenticity has focused on two inter-related dimensions: self-discovery and self-creation. In this paper, we develop a broader framework that includes the experimental and relational dimensions of authenticity, both understood as decisive for shaping one’s narrative identity. In our view, neurointerventions that alter someone’s personality traits will also impact her very own self-understanding across time. We argue that experimental authenticity only needs a minimum conception of narrative coherence of the self and that reversibility should remain (...) a key feature in the ethical assessment of neurotechnologies. The relational dimension of authenticity derives from the fact that a process of self-constitution is never a solitary business. The significant others act not just as subsequent judges of one’s life decisions, but as real co-authors of one’s self. We discuss relevant cases in which others are actively contributing to the meaning-making process, as to the direction one’s life is taking. We also claim that the experimental and the relational dimensions of authenticity should aim to correct each other. The relational dimension introduces socially approved standards as well as limitations to the array of available possibilities of self-fashioning or human enhancement. The experimental side enables us to avoid confusing one’s personal identity with a social and narrative construct that only bears the mark of social pressure and conformism. (shrink)

Resumen: Este trabajo analiza el libro Fuerzas Especiales en cuanto a cómo ciertos elementos claves de la novela, a saber: hacinamiento, pobreza y violencia circunscriben las subjetividades de sus protagonistas generando una inmutable tensión. Se examina el lenguaje utilizado por Eltit en referencia a las figuras retóricas utilizadas y cómo estas constituyen un discurso letal y violento cuya lectura se ve desplazada hacia territorios oscuros e intrincados. Estos territorios son dominados por un Estado cuya esencia se devela por medio de (...) una retórica que es social y políticamente alegorizada por medio de un lenguaje físico y simbólico -la retórica de la represión- que conmina a sus personajes a ser parte de una dialéctica que encarcela y confina sus vidas y almas pero que, de igual forma, abre la posibilidad de resistir estoicamente una ideología segregadora que vigila y restringe todo atisbo de emancipación.: This work analyzes the book Fuerzas Especiales regarding how some specific elements, namely: overcrowding, poverty and violence restrict the subjectivities of the main characters, creating an unchanging tension. Likewise, it examines the language that has been used by Eltit as for the use of rhetorical figures and how these ones make up a deadly discourse whose reading is shifted toward dark and abstruse territories. These territories are dominated by a nation whose essence is unveiled through a rhetoric that socially and politically is allegorized by way of a physic and symbolic language -the rhetoric of repression- that compels its characters to become part of a dialectic that locks up and confines their lives and souls; however, it opens up a possibility to stoically resist a segregating ideology that surveils and limits any glimmer of emancipation. This paper argues for a revised concept of authenticity entailing two demands that must be balanced. The first demand moves authenticity from the position of a strictly self-regarding virtue towards the position of a fully social virtue, acknowledging the crucial feature of steadiness, i.e. self-consistency, as being precisely what we ‘naturally’ lack. Nevertheless, the value of personal authenticity in a modern, open society comes from the fact that it brings about not only steadiness, but also the public development of a (...) variety of existential options that can be understood as Millian ‘original experiments in living’. Thus the second demand of authenticity is a demand for ‘experimental’ authenticity which covers the whole spectrum of technologies of the self, from Nietzschean ‘brief habits’, to the use of enhancement technologies. Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. El desarrollo del escrito es un examen de las formas de aparición del concepto en los poemas homéricos, para aislar su significado fundamental: primero en (...) la Ilíada, luego en la Odisea y finalmente, la relación que este concepto guarda con la noción de saber. The organizational account of biological functions interprets functions as contributions of a trait to the maintenance of the organization that, in turn, maintains the trait. As has been recently argued, however, the account seems unable to provide a unified grounding for both intra- and cross-generation functions, since the latter do not contribute to the maintenance of the same organization which produces them. To face this ‘ontological problem’, a splitting account has been proposed, according to which the two kinds of functions (...) require distinct organizational definitions. In this article, we propose a solution for the ontological problem, by arguing that intra- and cross-generation functions can be said to contribute in the same way to the maintenance of the biological organization, characterized in terms of organizational self-maintenance. As a consequence, we suggest maintaining a unified organizational account of biological functions. (shrink)

We reply to Artiga and Martinez’s claim according to which the organizational account of cross-generation functions implies a backward looking interpretation of etiology, just as standard etiological theories of function do. We argue that Artiga and Martinez’s claim stems from a fundamental misunderstanding about the notion of “closure”, on which the organizational account relies. In particular, they incorrectly assume that the system, which is relevant for ascribing cross-generation organizational function, is the lineage. In contrast, we recall that organizational closure refers (...) to a relational description of a network of mutual dependencies, abstracted from time, in which production relations are irrelevant. From an organizational perspective, ascribing a function to an entity means locating it in the abstract system that realizes closure. In particular, the position of each entity within the relational system conveys an etiological explanation of its existence, because of its dependence on the effects exerted by other entities subject to closure. Because of the abstract relational nature of closure, we maintain that the organizational account of functions does not endorse a backward looking interpretation of etiology. As a consequence, it does not fall prey of epiphenomenalism. (shrink)

Sperber and Mercier maintain that argumentation is a meta-representational module. In their evolutionary view of argumentation, the function of this module would be to regulate the flow of information between interlocutors through persuasiveness on the side of the communicator and epistemic vigilance on the side of the audience. The aim of this paper is to discuss this definition of argumen-tation by analyzing what they mean by “communicator’s persuasiveness” and “audience epistemic vigilance”.

En este artículo defendemos la existencia de un perspectivismo ontológico pluralista inherente a la filosofía de Baruch Spinoza. Indispensable para la constitución de esta noción es la relación establecida entre su teoría general de composición de los cuerpos y los conceptos de “afecto”, “inmanencia”, “potencia” y “multitud”. El objetivo de este análisis es una fundamentación interior del concepto de “puntos de vista”: es imposible pensarlo como una característica epistemológica de un individuo aislado, pero tampoco es posible unificarlo mediante el postulado (...) de una propiedad común. En consecuencia, el perspectivismo ontológico espinosista implica una teoría del punto de vista pluralista que elude los problemas planteados por la clausura del modelo Uno-Todo. (shrink)

In the philosophical debate on aging, it is common to raise the question of the theoretical definition of aging in terms of its possible characterization as a disease. Understanding aging as a disease seems to imply its medicalization, which has important practical consequences. In this paper, we analyze the question of whether aging is a disease by appealing to the concept of disease in the philosophy of medicine. As a result of this analysis, we argue that a pragmatist approach to (...) the conception of disease is the best alternative to highlight the relevance of the medicalization of aging. From this pragmatist perspective, it can be seen that the notion of aging is going through a conceptual change, and aging can today be understood as a not radically different process from any other condition that is usually considered a disease. Recent years have witnessed intensive efforts to specify which requirements ethical artificial intelligence (AI) must meet. General guidelines for ethical AI consider a varying number of principles important. A frequent novel element in these guidelines, that we have bundled together under the term explicability, aims to reduce the black-box character of machine learning algorithms. The centrality of this element invites reflection on the conceptual relation between explicability and the four bioethical principles. This is important because the application of general ethical (...) frameworks to clinical decision-making entails conceptual questions: Is explicability a free-standing principle? Is it already covered by the well-established four bioethical principles? Or is it an independent value that needs to be recognized as such in medical practice? We discuss these questions in a conceptual-ethical analysis, which builds upon the findings of an empirical document analysis. On the example of the medical specialty of radiology, we analyze the position of radiological associations on the ethical use of medical AI. We address three questions: Are there references to explicability or a similar concept? What are the reasons for such inclusion? Which ethical concepts are referred to? (shrink)

Barnes (2014) has argued in this journal for the following conditional: If there is any metaphysical indeterminacy, this must be at the most fundamental level of reality. To argue for this claim, Barnes relies on two principles that I shall call bivalent completeness and determinate link. According to the former, a complete description is a bivalent assignment of truth values to every sentence. The determinate link, instead, establishes that the determination relation between levels of reality preserves determinacy from one level (...) to another. In response to Barnes’ conclusion, Eva (2018) has recently pointed out that bivalent completeness is question begging. In this paper, I will first show why Eva's line of reasoning can be resisted. My aim will then be to present a stronger case against Barnes’ argument by challenging the determinate link. In the presence of metaphysical indeterminacy, the link between fundamental and derivative facts might itself be the locus of indeterminacy. I will conclude by showing that Barnes and Eva make many unwarranted assumptions regarding both indeterminacy and fundamentality. The logical space around the connection between these two notions appears to be much wider than what they seem to be aware of, or so I will argue. (shrink)

What are the main conditions that any theory of human rights should satisfy to guide action? If agents must take action for a fairer world as human rights discourse suggests, this is a crucial question to reflect upon. In this paper, I make a proposal. I argue that any theory of (moral) human rights that guides action on the basis of correlative duties must satisfy three key conditions. The first condition is focused on the specification of act-types, the second concerns (...) the distribution of correlative duties, and the third is focused on the resolution of (resolvable) conflicts of human rights. I show that this proposal has substantive implications because it implies to reject, challenge and, in some cases, resist ideas that are commonly accepted in the literature on human rights. (shrink)

El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. This paper examines the profile of the Albatros Publishing House in Bucharest (specialising in youth literature) and the activity of its director, writer Mircea Sântimbreanu. He held this position for almost two decades and recounted his experience in a volume of memoirs. I tried to explore these memoirs mainly in parallel with accounts from archival documents and secondary literature. The Albatros Publishing House was a micro-universe for assessing the impact of successive ideological offensives by the Romanian Communist Party on book (...) production and on the youth in general (mainly the July 1971 Theses and the other party directives of the 1970s, as well as the Mangalia Theses of 1983). By the 1980s, the regime’s propaganda had acquired ultra-nationalistic nuances. This paper will also exemplify such developments by discussing the scandal generated by the 1983 publication of Saturnalii by Corneliu Vadim Tudor, a volume of poems with strong antisemitic tenor. Using mainly diaries, journals, secondary literature and archival documents, this article also analyses the strategies deployed by the communist regime in order to coerce the young generation – through the agency of publishing houses – to assume the new literary-political ideology of revolutionary humanism (the Socialist Realism of the Ceaușescu era). The forfeiture thesis is posed as an independent thesis in moral philosophy according to which agents forfeit (or lose) rights if they perform certain act-types. According to many, this thesis plays a crucial role in the justification of (legal) punishment. In this paper, I argue that the forfeiture thesis is unnecessary – we can simply dismiss it without any substantive loss. Echoing an aspect of the specificationist approach to rights, the reason is that we may replace the forfeiture thesis with (...) an exception clause in the very content of the right not to be subjected to hard treatment: P has no right not to be subjected to hard treatment simpliciter, but a right not to be subjected to hard treatment unless P performs an act-type φ – e.g., murdering an innocent person. This alternative has substantive advantages over the forfeiture thesis, which, in turn, shows that the former cannot be reduced to the latter. (shrink)

The scope and type of property rights recognized over the effectiveness of antibiotics have a direct effect on how those claiming ownership engage in the exploitation and stewardship of this scarce resource. We examine the different property claims and rights the four major interest groups are asserting on antibiotics: (i) the inventors, (ii) those demanding that the resource be treated like any other transferable commodity, (iii) those advocating usage restrictions based on good stewardship principles and (iv) those considering the resource (...) as common heritage of humankind. Epistemic injustices are wrongs done concerning a person’s capacity as a knower. These actions are usually caused by prejudice and involve the distortion and neglect of certain marginalized groups’ opinions and ways of knowing. A type of epistemic injustice is hermeneutical injustice, which occurs when a person cannot effectively communicate or understand their experience, since it is excluded in scholarship, journalism, and discourse within their community. Indigenous Peoples (IPs) are especially vulnerable to hermeneutical injustice because their way of life is (...) unfamiliar or inaccessible to others. This leads to the exclusion of their ideas from public discourse, especially those important for human and societal development. This phenomenon is particularly evident in instances related to IP education. José Medina claims that there are cases of hermeneutical injustice which hinders the ability of people to share and make meaning, or simply, hermeneutical death. Ben Kotzee, on the other hand, identifies the specific educational dimension of epistemic injustice. Using both of these frameworks and citing the results of local studies on indigenous education as illustrative points, we attempt to show instances and scope of hermeneutical injustice in the education of IPs in the Philippines.
